General Terms and Conditions DRD Knaagdierwinkel B.V.
- Definitions
In these general terms and conditions, the following terms are defined as:
- DRD Knaagdierwinkel B.V.: the company offering products via the webshop.
- Customer: the natural or legal person who purchases products via the webshop.
- Webshop: the website where products from DRD Knaagdierwinkel B.V. are offered.
- Products: the goods offered on the webshop.
- Where 'animals' or 'rodents' are mentioned, it refers to 'non-food producing pets.'
- Applicability
These general terms and conditions apply to all agreements between DRD Knaagdierwinkel B.V. and the Customer, unless otherwise agreed. By placing an order, the Customer agrees to these terms.
- Offer and Agreement
All offers by DRD Knaagdierwinkel B.V. are non-binding and may be adjusted or withdrawn at any time. An agreement is formed when the Customer has placed the order. DRD Knaagdierwinkel B.V. reserves the right to refuse orders.
- Prices and Payment
All prices on the webshop are in euros and include VAT unless stated otherwise. DRD Knaagdierwinkel B.V. reserves the right to change prices on the webshop at any time. Payment must be made via the available payment methods on the webshop. The Customer is responsible for correctly completing the payment. If payment is not received on time, DRD Knaagdierwinkel B.V. reserves the right to cancel the agreement.
- Delivery
Delivery of the ordered products will take place at the address provided by the Customer, provided that the address is correctly filled in and the Customer can receive the package at the specified address. An exception is if the delivery service (e.g., PostNL) is unable to deliver the package to the specified address due to circumstances such as congestion or other unforeseen situations. In this case, the package may be delivered to an alternative location, such as a pick-up point. The order is considered delivered when the package arrives at this alternative location. The Customer is obligated to pick up the package on time at the indicated location. Any costs incurred due to the failure to pick up the package on time or for re-delivery will be passed on to the Customer. DRD Knaagdierwinkel B.V. strives to deliver the order as quickly as possible. However, DRD Knaagdierwinkel B.V. is not responsible for any delay in delivery caused by third parties, such as delivery services, or due to other unforeseen circumstances, including force majeure. Delivery delays do not entitle the Customer to cancel the agreement, claim damages, or request any other compensation. DRD Knaagdierwinkel B.V. is not liable for any damage that occurs during transport.
- Force Majeure
DRD Knaagdierwinkel B.V. is not liable for any delay or non-fulfillment of obligations if such delay or non-fulfillment is caused by force majeure, including but not limited to natural disasters, war, strikes, technical failures, failures by carriers, or other unforeseen circumstances beyond the control of DRD Knaagdierwinkel B.V.
- Right of Withdrawal
The Customer has the right to return the order within 14 days of receiving it. The right of withdrawal does not apply to products that cannot be returned for reasons of hygiene, perishability, or the nature of the product. This includes, but is not limited to, feed products, plants, terrariums, and animals, as well as products requiring special transport. If the Customer wishes to exercise the right of withdrawal, this is only possible for products that do not have any of the above limitations. The Customer is responsible for the return shipping costs.
- Warranty and Liability
DRD Knaagdierwinkel B.V. is not liable for any damage resulting from (incorrect) use of the delivered products. DRD Knaagdierwinkel B.V.'s liability is limited to the value of the respective product. In the case of damage, DRD Knaagdierwinkel B.V.'s liability is limited to the amount of the ordered products.
For certain products shipped via pallet delivery, if the Customer wishes to withdraw from the order for any reason, the Customer is responsible for returning the pallet shipment. It is possible that DRD Knaagdierwinkel B.V. arranges transport for the return, but in this case, the Customer is responsible for properly packaging the shipment and the return transport. The costs for returning the pallet shipment, as well as the risk of damage during transport, are entirely the Customer's responsibility. DRD Knaagdierwinkel B.V. is not liable for any damage that occurs during the return transport.
- Complaints and Disputes
Complaints must be submitted to DRD Knaagdierwinkel B.V. in writing within 2 days after receiving the product. If a complaint is valid, DRD Knaagdierwinkel B.V. has the choice to either replace, repair, or refund the purchase amount. If the complaint concerns a product, the EU responsible for the product will be involved in resolving the complaint. In some cases, it may be necessary to send the product to the EU representative for inspection or further handling. The Customer is obliged to cooperate and send the product to the EU representative if requested. DRD Knaagdierwinkel B.V. will provide the Customer with the necessary instructions for returning the product. If DRD Knaagdierwinkel B.V. makes an error by delivering the wrong product, the Customer will receive a return label. The incorrectly delivered product must first be returned before the correct product is shipped. The Customer is not entitled to further compensation, damages, or other reimbursements. If the Customer does not cooperate with the return shipment, we may charge fees for the wrongly delivered product. All disputes arising from the agreement between the Customer and DRD Knaagdierwinkel B.V. will be submitted to the competent court in the Netherlands.
- Intellectual Property
All content, images, designs, logos, product descriptions, and other materials presented on the website of DRD Knaagdierwinkel B.V. are the property of DRD Knaagdierwinkel B.V. and are protected by intellectual property rights. It is not allowed to use, reproduce, or distribute these materials without the prior written permission of DRD Knaagdierwinkel B.V.
- Privacy
DRD Knaagdierwinkel B.V. respects the privacy of its customers and processes personal data in accordance with applicable privacy legislation. For more information, see the privacy policy on the website.
- Final Provisions
DRD Knaagdierwinkel B.V. reserves the right to modify the general terms and conditions at any time. Changes will take effect as soon as they are published on the website of DRD Knaagdierwinkel B.V., unless otherwise stated. If any provision of these terms is declared invalid, the remaining provisions will remain in full force.
